Agreement to Terms

Welcome to Oopsify, a mobile application (“App”) developed by Dmitrii Cherviakov that allows users to create videos from their photographs. By accessing or using Oopsify, you (“User”) agree to these Terms of Use (“Terms”). If you do not agree to these Terms, you must stop using the App immediately.

Eligibility

By using the App, you represent that:

  • You are at least 18 years old or have obtained parental consent if required by local laws.
  • You have the legal capacity to enter into this agreement.

Use of the App

Oopsify grants you a non-exclusive, non-transferable, and revocable license to use the App solely for personal, non-commercial purposes. You agree to:

  1. Use the App Lawfully: Avoid any use that violates laws or infringes the rights of others.
  2. Not Abuse the App: Refrain from reverse engineering, copying, or modifying the App.
  3. Respect Intellectual Property: You retain ownership of your uploaded content, but Oopsify owns all rights to its software, designs, and trademarks.
  4. Avoid Harmful Content: You will not upload offensive, illegal, or harmful content through the App.

User-Provided Content

  1. Temporary Use of Content: Your data is retained only for as long as necessary to fulfill its purpose or comply with legal obligations. Video files and photographs uploaded to the App are processed temporarily and deleted automatically after generation.
  2. Responsibility for Content: You represent that you own or have obtained rights to use all content uploaded and that it does not infringe any third-party rights.
  3. Indemnity: You agree to indemnify and hold harmless Oopsify and its developers against claims arising from your uploaded content.

Disclaimer of Warranties

Oopsify is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to:

  1. Service Interruptions: We do not guarantee the App will be uninterrupted, error-free, or secure.
  2. Fitness for Purpose: No guarantee is made that the App will meet your specific needs.
  3. Data Loss: While we implement measures to protect user data, we are not liable for accidental data loss.

Limitation of Liability

To the fullest extent permitted by law:

  1. Oopsify and its developers will not be liable for any direct, indirect, incidental, consequential, or special damages arising out of your use or inability to use the App.
  2. In no event shall our aggregate liability exceed the amount you have paid for the App, if any.

Indemnification

You agree to indemnify and hold Oopsify, its developers, affiliates, and partners harmless from any claims, losses, or damages arising from:

  1. Your breach of these Terms.
  2. Your use of the App.
  3. Your violation of any laws or rights of third parties.

Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any violation of these Terms or at our sole discretion.

Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the developer, Dmitrii Cherviakov, is located, without regard to conflict of law principles.

Changes to Terms

Oopsify may update these Terms from time to time. Continued use of the App constitutes acceptance of the updated Terms. Significant changes will be communicated through the App or email.
